PRACTICAL GUIDE

From Initial Contact to a Clear Engagement

Understand the matter, verify the information, define the scope and document the arrangements so everyone understands the next step.

Initial contact: outline the matter

For an initial enquiry, describe the type of matter, identify the relevant parties and give a brief outline. Share complete sensitive documents only after the delivery method and necessary scope are clear. An enquiry or exchange of materials does not by itself establish an engagement.

Scope discussion: make the arrangements clear

Before substantive work begins, discuss whether the matter can be accepted, the scope, personnel, fees, documents required and communication arrangements. Identify anything still open and how it will be confirmed.

Formal engagement: record what has been agreed

Use agreed engagement documents to record the work and responsibilities. If circumstances change, discuss the implications for scope, timing and fees. Outcomes depend on the particular facts, documents, procedures and other relevant factors.

This is general guidance on organising information. It is not legal advice on a particular matter and does not replace an assessment by counsel after review of the facts.
